Canada and the United States impose separate disclosure rules for foreign assets and financial accounts. These forms do not necessarily create additional tax, but missing them can create significant compliance exposure.<\/p>\n<p>For Canadian residents, Form T1135 generally applies when the total cost amount of specified foreign property exceeds C$100,000 at any time during the year. For U.S. persons, the FBAR generally applies when the aggregate value of foreign financial accounts exceeds US$10,000 at any time during the calendar year. FATCA reporting for individuals generally occurs through Form 8938 and uses different asset definitions and higher thresholds. Filing one does not automatically satisfy another.<\/p>\n<h2><strong><b>Canada: Form T1135<\/b><\/strong><\/h2>\n<p>Form T1135, Foreign Income Verification Statement, is generally required for a Canadian resident individual, corporation, or certain trust that owns specified foreign property with a total cost amount of more than C$100,000 at any time during the year. Certain partnerships are also subject to the rule.<\/p>\n<h3><strong><b>The Threshold Uses Cost, Not Market Value<\/b><\/strong><\/h3>\n<p>The C$100,000 threshold is generally based on the cost amount of all specified foreign property combined. It is not based on current fair market value, mortgage equity, or the value of each asset separately. If the combined cost amount exceeds C$100,000 at any time during the year, the filing requirement may arise.<\/p>\n<p><strong><b>Example: <\/b><\/strong>A Canadian resident owns U.S. shares with a cost amount of C$70,000 and has C$40,000 in a U.S. bank account. The combined C$110,000 cost amount exceeds the threshold even though neither asset exceeds C$100,000 by itself.<\/p>\n<h3><strong><b>What Is Specified Foreign Property?<\/b><\/strong><\/h3>\n<p>Specified foreign property includes many assets situated, deposited, or held outside Canada. Common examples include foreign bank accounts, shares of non-resident corporations, interests in non-resident investment funds, debts owed by non-residents, and foreign rental or investment real estate.<\/p>\n<p>Important exclusions include personal-use property and property held exclusively in an active business. Specified foreign property held inside an RRSP, RRIF, TFSA, RPP, or certain other Canadian registered plans is also excluded from T1135 reporting.<\/p>\n<h3><strong><b>Foreign Real Estate<\/b><\/strong><\/h3>\n<p>Foreign real estate held primarily to earn rent or investment income may be specified foreign property. A vacation property used primarily for personal use is generally excluded. CRA treats whether a property is primarily for personal use as a factual determination.<\/p>\n<h3><strong><b>Simplified and Detailed Reporting<\/b><\/strong><\/h3>\n<p>Where total specified foreign property exceeds C$100,000 but remains below C$250,000 throughout the year, Part A simplified reporting is generally available. If the total cost amount reaches C$250,000 or more at any time during the year, Part B detailed reporting generally applies.<\/p>\n<p>Foreign income remains reportable on the Canadian income tax return even when the T1135 threshold is not met.<\/p>\n<h2><strong><b>United States: FBAR<\/b><\/strong><\/h2>\n<p>The FBAR is FinCEN Form 114, Report of Foreign Bank and Financial Accounts. A U.S. person generally must file an FBAR when the aggregate maximum value of foreign financial accounts exceeds US$10,000 at any time during the calendar year.<\/p>\n<p>The US$10,000 test is aggregate. A taxpayer with several smaller accounts may therefore have an FBAR filing requirement even if no single account ever exceeds US$10,000.<\/p>\n<h3><strong><b>Who Is a U.S. Person?<\/b><\/strong><\/h3>\n<p>For FBAR purposes, the term generally includes U.S. citizens, U.S. residents, and domestic entities such as corporations, partnerships, and limited liability companies created or organized under U.S. law, subject to the detailed rules and exceptions.<\/p>\n<h3><strong><b>What Accounts Are Commonly Reported?<\/b><\/strong><\/h3>\n<ul>\n<li>\u00a0Foreign bank and deposit accounts.<\/li>\n<li>\u00a0Foreign brokerage and securities accounts.<\/li>\n<li>\u00a0Certain foreign retirement and pension accounts.<\/li>\n<li>\u00a0Certain cash-value insurance or annuity accounts.<\/li>\n<li>\u00a0Accounts over which a U.S. person has reportable signature or other authority, subject to applicable exceptions.<\/li>\n<\/ul>\n<p>Directly owned foreign real estate is not a foreign financial account and is not reported on the FBAR merely because it is located outside the United States.<\/p>\n<h3><strong><b>FBAR Filing Deadline<\/b><\/strong><\/h3>\n<p>The FBAR is filed electronically with FinCEN, not with the federal income tax return. It is generally due April 15 following the calendar year, with an automatic extension to October 15.<\/p>\n<h2><strong><b>FATCA and Form 8938<\/b><\/strong><\/h2>\n<p>FATCA is a broader U.S. international tax compliance regime. For many individual taxpayers, the relevant personal reporting form is Form 8938, Statement of Specified Foreign Financial Assets. Form 8938 is attached to the taxpayer\u2019s annual federal income tax return.<\/p>\n<p>Form 8938 does not replace the FBAR. A taxpayer may need both forms for the same foreign bank, brokerage, or retirement account.<\/p>\n<p><strong><b>Form 8938 Thresholds for Individuals<\/b><\/strong><\/p>\n<p>[\/et_pb_text][et_pb_code specified domestic entities. Also, an individual who is not required to file a U.S. income tax return for the year generally does not file Form 8938 solely because the asset threshold is exceeded.<\/p>\n<h3><strong><b>What Form 8938 Covers<\/b><\/strong><\/h3>\n<p>Specified foreign financial assets generally include foreign financial accounts and certain foreign investment assets held outside financial accounts, such as stock issued by a foreign corporation, interests in foreign partnerships, certain foreign retirement plans, and certain foreign-issued insurance or annuity contracts with cash value.<\/p>\n<p>Directly owned foreign real estate is generally not a specified foreign financial asset for Form 8938. If real estate is owned through a foreign corporation, partnership, trust, or other foreign entity, the interest in that entity may itself be reportable.<\/p>\n<h2><strong><b>T1135 vs. FBAR vs. Form
